Ancillary Probate Proceedings in Germany

In the context of a probate proceeding american counsel is often confronted with the question of whether ancillary proceedings should be commenced in Germany where the decedent owned personal and/or real property in Germany. This article outlines those factual circumstances with which American counsel is most often confronted and discusses whether ancillary proceedings in Germany are required. It is presumed that the decedent had his last domicile in the United States and the estate contains real or personal property located in Germany.

Preamble

Paul D. Reinsdorf, Attorney-at-Law (hereinafter “Attorney”) makes available under the Internet portal www.reinsdorf.net articles and sample contracts (hereinafter “Files”) in digital form, which can be requested by anyone for payment and downloaded. In view of this the following agreement is entered into:

1. Order and Delivery

The user requests the Files electronically and Attorney makes them available electronically immediately after payment is made. The user ensures that his computer has the technical capabilities for the reception of the Files.

No Attorney/Client relation is created by delivery of the Files.

2. Terms of payment

The prices which the user has to pay for the Files arise from the respective on-line order form, which is a part of this agreement. All prices contain the legal value added tax.

3. Cancellation/Return

The user is aware that there is no right to cancel or return Files downloaded against payment or Files sent electronically against payment.

4. Liability

Attorney applied great care in producing the Files. Attorney nevertheless assumes no liability for incorrect, incomplete, or
information that is not current.

The Files serve merely as a reference point and in no event replace competent legal advice. The user has to check the Files for
completeness and where appropriate obtain competent legal advice before he uses the Files.

5. Copyright

The User is entitled to use the requested Files for own use. A use going beyond this is not allowed. In particular the commercial duplication and the resale of the Files is prohibited. All copyright, rights of use, and other protective rights in the Files remain with Attorney.

Copyright references of Attorney may be removed from Files [used ] by the user for his own use.

6. Final provisions

Where one provision of this agreement is or becomes invalid, the remaining provisions are not affected.

All disagreements concerning this arrangement are governed by the law of the Federal Republic of Germany.

Place of performance and legal venue is Frankfurt, provided that the user is a businessman.
