Opening a bank account is simple. Collecting the proceeds after the account holder’s death is another matter, especially where the account is located outside the United States. In this context a person undertaking the task of collecting a personal estate that includes funds in a German bank account is confronted with several uncertainties. Principal among these is the question of what proof the German bank will require to show the legitimacy of the person claiming to be a legal heir, executor or administrator (also referred to below as “Claimants” or individually as “Claimant”) This article discusses the reason for the bank’s proof requirement and makes suggestions on how to establish the Claimant’s legitimacy.
